A Huge Win for Lane Garrison

In a stunning ruling, Judge Elden Fox set the stage for Lane Garrison to become a free man in 90 days.


The judge ordered the former "Prison Break" star to go to state prison for 90 days. The purpose: for shrinks and others to determine if he's a suitable candidate for straight probation. The smart money is now on the judge letting Garrison go free after a mere 3 months in prison.

The order followed dramatic, gut-wrenching testimony during Garrison's sentencing hearing at the 90210 courthouse.

The father of the boy who died in the car Garrison was driving testified that Lane is a self-absorbed person: "He's selfish. He took no responsibility. He could have come to us the next day and apologized, but he didn't."

The father also said he was furious at Garrison's PSA, first run on TMZ. The PSA shows a remorseful Garrison fronting an anti-drinking spot recreating the fatal crash. The dad testified, "He is an actor. He is acting. He killed a human being and he killed our son." The dad said, "Yesterday was one of the hardest days. It was Vahagn's birthday. He would have been 18."


Garrison then testified, "I relive that night every day and I think about the bad decisions I made." Garrison, who plead guilty to vehicular manslaughter, said, "All I can say to you is that I'm sorry. I tried to contact you every day. This PSA was not a publicity stunt." Garrison added, "We can't bring him back, but I'm sorry for my behavior that evening and that is not representative of who I am usually."

Garrison's lawyers, Rich Hutton and Harland Braun, suggested the boy who died was partly responsible. Braun said, "The young man died because he was sitting in a car with a drunk driver." Braun also suggested Garrison may have been a victim as well -- and that before the crash, someone may have slipped him a drink with the date rape drug GHB.


The D.A. vehemently opposed the 90-day diagnostic exam, arguing that Garrison should get four years in prison.

91. I think the kid is just as responsible for putting himself in that car with him. He had to know he'd been drinking. So by him getting in the car with him he pretty much accepts responsibilty for what may happen. HE could have easily have driven if he hadnt been drinking also,which im not sure if thats the case. But if he hadnt drank at all that night why couldnt he have driven instead of Garrison? To me it'd be different if he'd actually hit an innocent bystandard because of drinking and driving. Not that it makes it any better but that kid chose to ride in that car that night. Garrison didnt MAKE him. Thats my point of view. It was an accident,a tragic one at that, and I feel bad for the family. I know what can happen riding with someone whos drank too much, and I know I wouldnt want to get into a car with that person. I would take it upon myself to either drive that person or call a cab.

This is a disgrace I wish all these people who lost a love one would get together a sue the govement for not BANNING ALCOHOL DRINKING IN PUBLIC PLACES LIKE THEY DID ON THE SMOKING BAN. 93. This is for posting 17 ..an error in judgment? Wow lol. Every single guilty person in jail made an error in judgement! Does that mean they shouldn't be punished for their crime? Just how many laws does he have to break before he deserves a normal prison sentence?! Lets see law number one ..buying alcohol for a minor ..law number two ...drinking and driving ...number three ...in posession of a narcotic ...number four ...having narcotics in his system WHILE driving a vehicle ...number five ...killing someone ...need I go on!? ..and those are only the ones he's been caught doing!!! Those laws are there for a reason. So that one human being doesn't endanger another human being or themselves. As adults we all know this. He knew this. If we aren't going to enforce the laws they shouldn't be there! Just because he's not a serial killer or rapist doesn't mean he shouldn't get punished properly. Someone was killed because of his error in judgment. That deserve much more than three months. Look at the 89 year old man who ran into people at the farmer's market. He was old and claimed he accidently hit the gas instead of the brakes. They gave him manslaughter which could have had a sentencing of up to 18 years! ..and yet a television star gets 3 months!? Ridiculous!

94. To #77 (blame the parents) Did you tell your parents exactly where you were going and exactly what you were going to do when you were in high school? There is a reason kids can't sign contracts and such. They are unable to foresee the consequences of their actions. That part of their brains isn't fully functioning yet - not til around 20.

How did the kids drinking make Garrison drink, then get behind the wheel?

If he would have been alone in the car and hit a pedestrian, would you blame the pedestrian for being on the streets at night?

95. Not to sound unremorseful, but at 17, I would not have gotten into a vehicle with a drunk adult, not only that, but I have seen "normal" people get off with a lot less, we should all hope that this is yet another lesson, not reprimand what cannot be undone...........

96. Instead of wasting your time being shocked that Lane received a mild sentence why don't you all look into how common this phenomenon really is. It is incredibly rare that a person receives punishment that fits the crime anymore. Lane has to wake up everyday and remember what he did; his own conscience is the ultimate retribution. Bless his heart.

98. i am happy for him. i think everything happens for a reason. i am sorry that a life was lost. i feel that he would be happy to bring that kid back and lane be the one to die. so i think this story is more real to heart than nichole, paris, and lindsay. i most def will keep lane and the others that this has touched in my thoughts.

101. That is disgusting and sad! Dude, you KILLED someone. People witnessed you drinking and doing rails of coke before you hopped in the car and KILLED a young man. To pull that lame ass "GHB in my drink" line is an absolute abomination to that man's family and to his memory. I don't know how some people sleep at night or look at themselves in the mirror. I hope they find during his "diagnostic" processing that he's nothing more than a narcissistic, cokehead, lying, LAME ASS MURDERER!!! I feel so terribly for that young man's parents and for the others in the car with that MURDERER!

103. Ok.....First of all....I have family that have died because of drinking & drugs so I can talk about this...Is it fair? No...but it is understandable. Bottom line...no one can briong this kid back. Its all about forgiveness...I watched his PSA and let me tell you...I CRIED! Acting or not...he got the message across to me and to my kids. I never had such a candid discussion about the effects of drugs and alcohol as we did after we watched this. Thats something!
