A Huge Win for Lane Garrison

In a stunning ruling, Judge Elden Fox set the stage for Lane Garrison to become a free man in 90 days.


The judge ordered the former "Prison Break" star to go to state prison for 90 days. The purpose: for shrinks and others to determine if he's a suitable candidate for straight probation. The smart money is now on the judge letting Garrison go free after a mere 3 months in prison.

The order followed dramatic, gut-wrenching testimony during Garrison's sentencing hearing at the 90210 courthouse.

The father of the boy who died in the car Garrison was driving testified that Lane is a self-absorbed person: "He's selfish. He took no responsibility. He could have come to us the next day and apologized, but he didn't."

The father also said he was furious at Garrison's PSA, first run on TMZ. The PSA shows a remorseful Garrison fronting an anti-drinking spot recreating the fatal crash. The dad testified, "He is an actor. He is acting. He killed a human being and he killed our son." The dad said, "Yesterday was one of the hardest days. It was Vahagn's birthday. He would have been 18."


Garrison then testified, "I relive that night every day and I think about the bad decisions I made." Garrison, who plead guilty to vehicular manslaughter, said, "All I can say to you is that I'm sorry. I tried to contact you every day. This PSA was not a publicity stunt." Garrison added, "We can't bring him back, but I'm sorry for my behavior that evening and that is not representative of who I am usually."

Garrison's lawyers, Rich Hutton and Harland Braun, suggested the boy who died was partly responsible. Braun said, "The young man died because he was sitting in a car with a drunk driver." Braun also suggested Garrison may have been a victim as well -- and that before the crash, someone may have slipped him a drink with the date rape drug GHB.


The D.A. vehemently opposed the 90-day diagnostic exam, arguing that Garrison should get four years in prison.

76. Oh heck. Our freaken Govenor, ( who had a many press confrences BRAGGED about his "need for speed", and about how many times he had "gotten off") killed a biker a few years ago. He blew a stop sign going 70 mph in a 55 mph zone! Never once did he apologize to the family. He received 90 days in jail ( a plush cell I'm sure) and had his law license revoked. The family sued, however, the great and almighty Bill Janklow CLAIMED he was on state business and the case was thrown out. He is now back to practicing law and building a new multi million dollar mansion!

It is obvious that if you "are somebody" you can get away with just about anything! Ask OJ or Robert Blake!

77. here's the thing. yes, he was incredibly stupid for driving drunk and allowing minors to drink with him and drive with him. but those kids are also INCREDIBLY stupid for getting into a car with him! the boy said he went with them because he was scared the girls would get hurt. He could have told the girls not to go with him...and the girls, I believe, are partly to blame too. They said "we were scared". I'm pretty sure if I was scared of getting into a car with someone, I JUST WOULDN'T DO IT! the reason they got into that car was because he was a celebrity and they wanted to hang out with him. Basically, its dumb choices made by everyone. I think he should get some jail time, but people need to realize he didn't force those kids into his car.

78. Garrison should not be held responsible for this deplorable sentence. If you recall, he already plead GUILTY to ALL charges. No trial, no plea bargain, no deals. He went into court today fully expecting to go to jail. It wasthe JUDGE who screwed up this time.

79. This is BS, he should serve time. I've lost a son to a wreckless driver with little to no charge being given. I hope this family sues the crap out of him, he deserves it. No nothing can bring back their kid but this guy deserves more than he is getting. For all of you who haven't had your child killed via drunk driving, wreckless driving etc really have no room to judge this family. They will be changed forever and will suffer without their child. They will live a nightmare the rest of their lives. Speaking from experience.

81. he has to live with killing someone for the rest of his life. No way did he get off easy how would you feel if you killed someone? justice will never be doine as we can't bring back the person killed? so live with it

82. WowTrue Hollywood style..You kill a dog..and you can get life in PRISON..you kill a HUMAN and u get 90- days...The Hollywood court SUC'S . There should be an investigation of ALL the rat bastard Judges who constantly give these SPOILED ROtten KIDS BREAKS..They must be paying these judges on the side..

Why arent any of these court judgement done by a JURY..seems like it's the judges who are giving out these LIGHT sentences

83. I totally agree with #72 @ 3:44. Unlike some people, Lane Garrison owned up to his mistakes. Those of you who are spewing hatred are no better than him. You are worse because your intentions, unlike his, are cruel and hateful.

85. DDog69 Post #66, it's not an accident when you get behind the wheel of a car drunk, then it becomes a crime, because he was driving under the influence is a crime, and you become a killer when someone dies while committing that crime. You should join YESS in her fantasy world!
No matter how much remourse you have for what you have done, that person is still dead and you are still responsible for that death. Sheesh what next, you can walk up and kill on the streets and not go to jail for it? Stop with the bleeding heart crap!! Do the crime, do the time!!!!

I believe they could have given him more time in prison> But then he does and will have this over his head for the rest of his life and he will not be allow to forget it with the media and TMZ there to make him remember it. He will I am sure have to do a lot of community time and volunteer work for his probation and that will be a lot of time he will have of reliving what a bad choice he made that night.
But let's not FORGET! here HE truly is not the ONLYGUILTY PARTY, those KIDS knew EXACTLY what they were getting themselves into. COME ON! MOST OF US HAVE PUT OUR SELF'S IN THAT SAME SITUATION AT ONE TIME OR ANOTHER IN OUR LIFE AND WE GOT LUCKY AS WELL AND THE INNOCENT PEOPLE WE COULD HAVE HURT..............
I am sure this will have an effect on his career as well SHOOT he may even give up the lime lite, we don't know what is going on in his head RIGHT! TMZ only from what I have come across on the site. I am sure he is sincere in the remorse he has and I feel he is VERY sincere when he apologizes to the families of the kids. As we all would be but if we were in his shoes. Grant it we would not all have the cash for high price attorney's.
I am sure as TMZ will agree with me they (the families of the kids) will get all they can from him in a civil suite RIGHT????????

90. "Just an accident" my ass! When you drink and choose to get behind the wheel, a crash is no longer an 'accident'. A judge would eat you alive if you said that in court. Sure, you didn't mean for it to happen, but you are still responsible for the consequences of your decision to take that risk. You weren't 'accidentally' behind the wheel.

The family must be livid.

Revenge? That is part of repaying your debt to society.
