A Huge Win for Lane Garrison

In a stunning ruling, Judge Elden Fox set the stage for Lane Garrison to become a free man in 90 days.


The judge ordered the former "Prison Break" star to go to state prison for 90 days. The purpose: for shrinks and others to determine if he's a suitable candidate for straight probation. The smart money is now on the judge letting Garrison go free after a mere 3 months in prison.

The order followed dramatic, gut-wrenching testimony during Garrison's sentencing hearing at the 90210 courthouse.

The father of the boy who died in the car Garrison was driving testified that Lane is a self-absorbed person: "He's selfish. He took no responsibility. He could have come to us the next day and apologized, but he didn't."

The father also said he was furious at Garrison's PSA, first run on TMZ. The PSA shows a remorseful Garrison fronting an anti-drinking spot recreating the fatal crash. The dad testified, "He is an actor. He is acting. He killed a human being and he killed our son." The dad said, "Yesterday was one of the hardest days. It was Vahagn's birthday. He would have been 18."


Garrison then testified, "I relive that night every day and I think about the bad decisions I made." Garrison, who plead guilty to vehicular manslaughter, said, "All I can say to you is that I'm sorry. I tried to contact you every day. This PSA was not a publicity stunt." Garrison added, "We can't bring him back, but I'm sorry for my behavior that evening and that is not representative of who I am usually."

Garrison's lawyers, Rich Hutton and Harland Braun, suggested the boy who died was partly responsible. Braun said, "The young man died because he was sitting in a car with a drunk driver." Braun also suggested Garrison may have been a victim as well -- and that before the crash, someone may have slipped him a drink with the date rape drug GHB.


The D.A. vehemently opposed the 90-day diagnostic exam, arguing that Garrison should get four years in prison.

Why did a 17 year old get in a car with a drunk dumbass?? Maybe because he's 17 years old Immature and was DRUNK TOO. Ever think of that. Garrison is the ADULT.

my sister-in-laws niece on her side of the family was killed in a drunk driving accident by her best friend and we all hope she HANGS...the kids and adults should take responsibility for their actions...ALL KIDS AND ALL ADULTS...MY PARENTS WOULD NEVER HAVE GOTTEN ME OUT OF ANYTHING HAD I DONE WRONG...

63. Just goes to show you that celebrities are getting preferential treatment because of their fame, and no judge wants to be the one to put a famous person away for a crime they committed. So he's remourseful? Let him think about the life he took by making the decision to get behind the wheel drunk, IN JAIL!! That's where anyone else who did this would be! Judge's need to stop being pansy's and stand up for our legal system, which is doing a fast downward spiral in to oblivion!! Lock his azz up!!!

66. This is just my two cents but ...I think that judges should have to be picked much in the same way that jurors are in celebrity cases. For all we know this judge could be a big fan of Prison Break and therefore sympathizes with the guy. It's harder to slap punishment if you feel like you know them personally (even if it is just television). Give the lawyers a group of judges to choose from until both sides agree then procceed. Obviously from the past (O.J., Nicole RIchie, Paris Hilton and so forth) we see that not all people are created equal under the law. We can complain all we want, but unless we do something the legal system will continue to jail the poor and slap the rich and famous on the wrist.

67. Should Lane Garrison get a sentence that the rest of us would get if we did his crime....of course. But the kid that dies was 17 and well aware of right and wrong. He knew drinking was illegal before the age of 21, he knew it was dangerous to ride with a drunk driver. Why isn't any pointing out that Lane was stupid fo rhis actions, but this kid was just as responsible for being in the accident. He could have chosen to not ride with Lane, in fact he could have made a better choice to not drink at all. I feel for Lane that he is getting all the blame when the kids in the car as just as guilty.

68. Unbelieveable, assessing any blame at all to the kid that got killed is just stupid. If Garrison wasnt a celeb, you'd be singing a different tune. Driving drunk and killing someone, regardless of what state the vicim is in, is manslaughter, nothing more, noting less. My heavens, that's like blaming a young girl for getting raped because she was wearing skimpy clothing. I actually do believe that the celeb is somewhat remorseful, but so what? He did it, he should pay a serious price ...

is there any way we can nuke Hollywood with all of these lame ass celebs in it???? I for one would be MORE THAN HAPPY to hit the "go" button

I have no faith left in the legal system once again in LA it has failed not only failed it is completly outrageous are you kidding me, its also actually quite frighting the fact is if you dont have alot of money and are not a celebrity your screwed i only hope and pray i never get into trouble because i am sure i will get shafted I am not a celebrity. 71. Last time I checked Lane Garrison is suppose to be an adult, able to assume responsibilty for his actions. If he was 17 maybe then he should be given a second chance, but not at his age. I was at the funeral for Vaghn and saw his parents mourn their only childs senseless death at the hands of Mr. Garrison. He should have to park his ass in prison for at least 10 years and maybe the next moron won't buy alchol for minors and take them for a drive. If you are a celebrity, in the public eye, you should be held to a much higher standard, for the simple fact that young peole look up to you and want to be like you. If you can not stand the heat, get the hell out of the kitchen and the acting business. Judge Fox I can tell you that probation is for people who don't pay their tickets, not for people who kill kids.

72. A couple people I went to school with were charged with vehicular manslaughter (separate incidents). They each served one year. He's getting off pretty easy in the legal system, but don't think he's not suffering for this one. That said, I would be very disappointed in this sentencing if I was a family member of the deceased.

BUT, if you want to pick on somebody, pick on these people who served NO TIME and took NO RESPONSIBILITY. Rebecca Gayheart didn't serve one single day! Nor did she take any responsibility for her actions.

73. This is the usual sentence. The drunk and high guy who was driving the car my brother-in-law was killed in got 90 days in jail, his driver's license returned to him in 9 months, and about $2000 in fines. It wasn't his first DUI either. Sure they are arresting drunk drivers, but then they get off easy.
It is just wrong.

Blame a kid who probably had no clue he was that impaired, and yes, blame the parents, but in noooo, let's not blame the person who decided he was going to get behind the wheel of a car drunk, and drive it, drunk, then wreck it and kill another person. Nope, not his fault one bit..all the kids fault, oh and the parents. You are a moron!! SO he's a movie star, or tv star or whatever, he should still have to pay for his wrongdoing. It IS against the law to drive under the influence of any mind or mood altering substance, at least last time I checked.
But you go on living in a fantasy world where only the people who are as moronic as you can understand why you think the way you do. Us real people who live in the real world will fight to have a fair and just legal system that treats every person who lives here as they should be treated.

75. I am so happy that he is getting what he is. I feel that he is not all to blame for what happened. No one made that kid get into teh car with Lane, no one made Lane give him the alcohol, no one made him accept that alcohol. The point is that everyone is their own person and you and only you are going to make choices based on what YOU want. So each person involved in this case is the only person to blame. It's unfortunate that someone did die, and others were hurt, but it was because THEY made poor choices. To blame this all on Lane is stupid. He didn't make those kids get in that car with him. They CHOSE to get in that car with him. I am sure if that kid were alive he would be in trouble right along side for UNDERAGE drinking. And one more thing....why in the world are these parents who are upset letting their UNDERAGE kids go out drinking at a party??? 15? Come on now, that is 6 YEARS under the LEGAL LIMIT...let alone the 17 year old who was killed was 4 YEARS. I think the people who really need to be blame are the parents for being irresponsible...if they wouldn't let their UNDERAGE kids out drinking in the first place, NONE OF THIS WOULD HAVE HAPPENED!!!!!!!!!!
