A Huge Win for Lane Garrison

In a stunning ruling, Judge Elden Fox set the stage for Lane Garrison to become a free man in 90 days.


The judge ordered the former "Prison Break" star to go to state prison for 90 days. The purpose: for shrinks and others to determine if he's a suitable candidate for straight probation. The smart money is now on the judge letting Garrison go free after a mere 3 months in prison.

The order followed dramatic, gut-wrenching testimony during Garrison's sentencing hearing at the 90210 courthouse.

The father of the boy who died in the car Garrison was driving testified that Lane is a self-absorbed person: "He's selfish. He took no responsibility. He could have come to us the next day and apologized, but he didn't."

The father also said he was furious at Garrison's PSA, first run on TMZ. The PSA shows a remorseful Garrison fronting an anti-drinking spot recreating the fatal crash. The dad testified, "He is an actor. He is acting. He killed a human being and he killed our son." The dad said, "Yesterday was one of the hardest days. It was Vahagn's birthday. He would have been 18."


Garrison then testified, "I relive that night every day and I think about the bad decisions I made." Garrison, who plead guilty to vehicular manslaughter, said, "All I can say to you is that I'm sorry. I tried to contact you every day. This PSA was not a publicity stunt." Garrison added, "We can't bring him back, but I'm sorry for my behavior that evening and that is not representative of who I am usually."

Garrison's lawyers, Rich Hutton and Harland Braun, suggested the boy who died was partly responsible. Braun said, "The young man died because he was sitting in a car with a drunk driver." Braun also suggested Garrison may have been a victim as well -- and that before the crash, someone may have slipped him a drink with the date rape drug GHB.


The D.A. vehemently opposed the 90-day diagnostic exam, arguing that Garrison should get four years in prison.

317. this is absolute garbage. My best friend also did the same thing. Yes, she drove drunk and killed her 17 year old passenger. She is also 17, but she is facing 10 years of jail because, in my state, at 17 you get tried as an adult. She learned her lesson too, but no one seems to care because she wasn't on some hit show for 10 seconds. I hope this judge gets investigated for something like this

319. This is an OUTRAGE!
Celebrity was doing an illegal substance, knowingly ingesting cocaine, driving while intoxicated....there should be NO LENIENCY. If coke is illegal, then is there no prosecution for ingesting it, AND KILLING SOMEONE!
What will be accomplished is that if he goes to JAIL LONGER, SPOILED LAWBREAKING CELEBRITIES will reconsider their actions.

320. What bothers me is that now - Brandy who is in a major lawsuit over hitting a car who hit another car and someone unfortunately died - she is facing some real major time! This is a horrible horrible blow to the justice system and if Brandy doesnt get the same treatment I guarantee that brings a huge racial war in Hollywood. I would not blame them...Lane Garrison should be facing at LEAST 25 yrs or more....

321. THANKS FOR GOD!!!!Im sooo happy to hearing he only got 90 days. I think he doesnt deserve more. I dont understand you people why you hate him so much ?! He is a great actor, a nice person, a sweet guy. everybody makes mistakes in his life, he did one... But he's NOT guilty.

322. I love Lane Garrison i thought that he was amazing in Prison Break, HOWEVER!!!!! when you drink and you drive and take the life of someone else. It doesn't matter who you are, you should pay for your actions. It sickens me to think that the world we live in is warped and that if that was your or I that was in that car and killed someone we'd get at least 5 years or more for killing someone while DUI. Its not right. Paris, Nicole, Lindsay and Lane should all be in jail for the crimes they have committed but no because they have money and fame that all goes out the window. Im disgusted!!!

323. You're all forgetting something -- this wasn't a trial, it was a hearing.

Nobody was under oath and there was no sworn testimony or evidence. What you heard from the Setian's parents, friends and family were victim impact statements, not testimony.

If there had been a trial, Lane's lawyers would have been defending him with forensic evidence showing the coke use had been days before, the alcohol blood levels were from how long after the crash, that the dead 17 year-old dragged the 15 year-olds with him so Lane wouldn't just dump them on a street corner instead of looking for a liquor store that would sell Vaghan booze. How many people does it take to buy booze in your neighborhood?

As his lawyer said at the hearing, "My client pleads guilty to the crime, not the stories."

Lane plead guilty so those kids and their folks wouldn't have to testify about how much they contributed to the tragedy as well. If he was the big sociopath everybody seems to think he is, he wouldn't have cared who he smeared to try to get off.

Not everybody who appears on TV or in films is rich, not everybody who gets killed in an accident is without blame, and not everybody is man enough to accept blame without fighting back.

IM VERRY HAPPY HE ONLY GOT 90 DAYS. everyone makes mistakes every now and then and i dont think this is really lane who did this. he was a differnet person at this time and it was his fault that the kid got into the car with him. i dont think jail time is neccessary at all.. rehab maybe.

325. 1) he hasnt only gotten 90 days, this is only an examination period, after that he may get up to 4 years and 8 months.
2) you cant call it murder, that is when u kill someone on purpose, garrison made a stupid descision and the thought of what he did will be with him for the rest of his life
3) dont forget the young lad chose to get into the car so he is partly responsible

I truly think it's a sad day in the American justice system, when a grown man under the influence of drugs and alchohal,uses his celebrity to intise three minors into taking a ride with him in his car, offers them the minors alchohal, gets in to an accident, which happens to leave two of the teens injured and the third one dead and all he gets is a 90 day sentenced. Why did'nt Garrison opt to make his public service commercial in the style that master card uses . Offer minors alchohal, $300.00. Driving under the influence, $500.00. Take a life $2.00. Serve 90 days, PRICELESS. My supervisor at work share my views 100%.

327. I have a 19 year old son who is currently in LA county jail for something he didn't do; but because I am of no importance and neither is he we have to wait for justice to maybe prevail. Maybe we can have that judge hear my sons case and he can go home too? Mr. Garrison you have been so blessed to have your freedom restored to you I hope you realize that and give praise to the Lord. As for me I miss my son so much and I pray everyday for his safety in LA county and his freedom someday soon. I pray for the parents who lost their only child that they have strength and forgiveness. For all parents who have children incarcerated prayer and trust in the LORD to keep our children safe.

328. first of all Lane is gorgeous-and becasue of that why should his beauty be wasted in prison-lane should be free-so we can see him on film like he should be-and when I was 17 I could defend myself I mean 17 is really a man besides the guy who dies isnt famous or anything

330. Where is the public outcry from MADD or organizations that exist to prevent child abuse? Mike Vick killed some DOGS, not a human being, and he's been crucified and looking at a year in jail. This guy has underaged girls in his car, gives them booze, drives drunk with coke in his system, KILLS (not injures) a young man, and gets 3 months? Talk about a "Prison Break"!
